1. Acceptance of Terms
By accessing and using the AirCare Japan website and booking our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our website or services. We reserve the right to modify these terms at any time. Your continued use constitutes acceptance of any updated terms.
2. Scope of Services
AirCare Japan provides professional air conditioning repair, maintenance, cleaning, installation, and troubleshooting services as described on our website. All work is performed by licensed and certified technicians. Service specifications, timelines, and pricing are outlined in individual service quotes and contracts. We cannot guarantee specific outcomes due to factors beyond our control.
3. Booking and Scheduling
Bookings are made through our online form or by phone during business hours (Monday–Friday, 9:00 AM–6:00 PM JST). Confirmation is provided via email or SMS. Customers are responsible for providing accurate location and contact information. We make best efforts to meet scheduled times but do not guarantee exact arrival windows due to traffic and prior appointments.
4. Payment Terms
Payment is due upon completion of service unless otherwise agreed in writing. We accept credit cards, bank transfers, and other payment methods as indicated. For installation and major projects, a 50% deposit may be required upon booking, with the balance due upon completion. Prices are in Japanese Yen and do not include applicable taxes unless stated.
5. Cancellation and Rescheduling
Customers may cancel or reschedule bookings with at least 24 hours' notice without penalty. Cancellations within 24 hours may incur a cancellation fee equal to the estimated service charge. No-shows will be charged the full service fee. Rescheduling is subject to technician availability and may incur scheduling fees.
6. 90-Day Workmanship Guarantee
We guarantee all workmanship for 90 days from the service completion date. If a repair fails or service is unsatisfactory due to our workmanship, we will re-perform the work at no charge. This guarantee does not cover damage from misuse, accidents, subsequent work by other parties, or acts of nature. Additional parts or repairs may be charged separately.
7. Customer Responsibilities
The customer is responsible for: (a) providing safe and unobstructed access to the service area; (b) disclosing any known system issues or hazards; (c) maintaining the service area in a clean, safe condition; (d) following all technician recommendations for system operation and maintenance; and (e) paying invoices in full and on time.
8. Limitation of Liability
AirCare Japan's total liability for any claim arising from these terms or our services shall not exceed the amount paid by the customer for the specific service. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits or business interruption, even if advised of such possibility.
9. Indemnification
The customer agrees to indemnify and hold harmless AirCare Japan, its employees, agents, and contractors from any claims, damages, losses, or expenses (including legal fees) arising from: (a) the customer's breach of these terms; (b) the customer's misuse or operation of the air conditioning system contrary to technician guidance; or (c) third-party claims related to the customer's property or use of our services.
10. Dispute Resolution
Any disputes arising from these terms or our services shall first be addressed through good-faith negotiation. If not resolved within 30 days, disputes may be submitted to mediation or arbitration in accordance with Japanese law. The customer agrees that any legal action must be filed within one year of the dispute arising.
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Japan. Both parties agree to the exclusive jurisdiction of the courts of Japan for any legal proceedings arising from these terms.
